Welcome! StepFly is a brand known for its quality products and services. Here are the terms and conditions of the Stepfly.

The terms “I” /"We" /"Us" /"Our" /”Company” /”StepFly” /”App” individually and collectively refer to StepFly Innovations Private Limited and the terms "You" /"Your" /"Yourself" /”User” refer to the users.

By accessing or using any part of the product or Service or both , you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. Stepfly may amend, update or change these Terms and Conditions. If you do not agree to abide by these Terms and Conditions, you are not authorized to use, access or participate in the product or Service or both.

Stepfly may, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Service, temporarily or permanently.

2. Acceptable App Use

2.a Security Rules

Visitors are prohibited from violating or attempting to violate the security of the App, including, without limitation,

(1) accessing data not intended for such user or logging into a server or account which the user is not authorised to access,

(2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation,

(3) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or 'Trojan horse' to the App, overloading, 'flooding', 'mail bombing' or 'crashing', or

(4) sending unsolicited electronic mail, including promotions and/or advertising of products or services.

Violations of system or network security may result in civil or criminal liability. The business and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

2.b General Rules

Visitors may not use the App in order to transmit, distribute, store or destroy material

(a) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation,

(b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or

(c) that is libellous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful.

3. Indemnification of StepFly

You agree

to defend, indemnify and hold harmless Stepfly and its directors, officers, employees, contractors, agents, suppliers, licensors, successors and assigns, from and against any and all losses, claims, causes of action, obligations, liabilities and damages whatsoever, including attorneys' fees, arising out of or relating to your access or use of the Service, any false representation made to us (as part of these Terms and Conditions or otherwise), your breach of any of these Terms and Conditions,or any claim that any service we provide to you is inaccurate, inappropriate or defective in any way whatsoever.

4. Limitation of Liability

User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that the Company shall not be responsible or liable to the user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

5. Termination Or Suspension of Account

Your access to the account

Stepfly may block, restrict, disable, suspend or terminate your access and use of the product or Service or both immediately at any time, for any reason, and at such time you will have no further right to use the Service or product or both at its own discretion without prior notice to you upon Stepfly .

You may terminate your stepfly account at any time by following the instructions available through the App or contacting us at the details provided at the end of this document.

The provisions of these Terms and Conditions relating to the protection and enforcement of Stepfly's proprietary rights, your representations and warranties, disclaimer of representations and warranties, release and indemnities, limitations of liability and types of damages, ownership of data and information, governing law and venue, and miscellaneous provisions shall survive any such termination.

6. Content Use

6.a Submission of Content

In relation to any content submitted, uploaded or generated by you to the Stepfly by any means, you hereby grant an unconditional, unlimited, perpetual, royalty-free, worldwide license and permission to Stepfly and its affiliates, content sharing partners to display, store, host, publish, digitally reproduce or copy, transmit, communicate, modify, translate, distribute or otherwise make such content available on the Platform or in relation to the Services provided by Stepfly. You agree that such content may continue to be made available on Stepfly despite any termination or suspension of your account. If such content has been shared, stored or embedded by any other user(s), you agree not to hold Stepfly responsible for the aforesaid activities in relation to your content.

6.b Personally Identifiable Information

You agree NOT to include any personally identifiable information in the content uploaded. In case you decide to do so, we are not responsible for any loss or damage you incur as this information may be available in a publicly accessible domain.

6.c Use of StepFly Content

All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned, or used under licence, by the business and / or its associate entities who feature on this App. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited.

You may not sell or modify the content of this App or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the respective organisation’s or entity’s written permission.

8. Miscellaneous

8.a Usage terms

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to StepFly.

StepFly is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The StepFly app stores and processes personal data that you have provided to us, in order to provide my Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the StepFly app won’t work properly or at all.

You should be aware that there are certain things that StepFly will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but StepFly cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, StepFly cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, StepFly cannot accept responsibility.

With respect to StepFly ’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. StepFly accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. StepFly does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device.

However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination,

(a) the rights and licenses granted to you in these terms will end;

(b) you must stop using the app, and (if needed) delete it from your device.

These terms and conditions are effective as of 20th Aug 2020.
